Fraud
We have considerable experience of defending people accused of the whole spectrum of fraud offences., from relatively straightforward diversion frauds to allegations of a highly complex and technical nature involving millions of pounds. Sansbury Campbell has been selected for inclusion on the Legal Services Commission's Very High Cost Cases Panel - a panel comprised exclusively of firms who have demonstrated their particular competence and experience in fraud matters. It is of particular note that only a small number of Panel Firms have a base in the West Country and South Wales. Whether you are currently facing investigation or prosecution for a fraud related offence, contact us to discuss matters further or arrange a meeting.
VAT Evasion and Inland Revenue Offences
The investigation and prosecution of offences in relation to Value Added Tax is the responsibility of Officers of HM Customs & Excise. Before a decision is made on prosecution, it is often possible to conduct negotiations so that a prosecution may be avoided. Alternatively, if prosecution is unavoidable, we will vigorously and pro-actively represent your interests. The case may involve the analysis of lengthy and complex documentation, use of information technology, or the instruction of expert witnesses: we have substantial experience in all of these areas. We have defended many individuals prosecuted for offences in this field, from small business people who have not paid tax for some years, to those implicated in multi million pound tax avoidance schemes, so-called "boiler house" frauds, "carousel" frauds etc
DTI Prosecutions
The Department of Trade and Industry has responsibility for prosecuting a large number of offences involving the conduct of companies and company officers, including Directors. At Sansbury Campbell we have successfully defended several individuals investigated or charged in these circumstances. The case may involve the analysis of lengthy and complex documentation, use of information technology, or the instruction of expert witnesses: we have substantial experience in all of these areas.
Health and Safety
It is without doubt that in recent years prosecutions for health and safety offences, particularly where serious incidents have occurred, are on the increase. Very often local authority Health and Safety Departments can be willing to discuss, negotiate and compromise and thus a prosecution can be avoided. We have achieved success for clients in this field. Unfortunately, prosecutions are sometimes inevitable: at Sansbury Campbell, we have substantial experience of defending companies in order to achieve the best result possible in the circumstances. We have advised in connection with allegations of corporate manslaughter, a developing legal area. We have successfully minimised the financial penalties on companies by presenting a true and balanced account of clients' legal responsibility which has been accepted by Courts.
Proceeds Of Crime Act
We provide a service covering the whole range of offences and procedures within the Act which are connected to criminal investigations - in particular we specialise in cases involving Asset Recovery/Confiscation and Money Laundering offences. We are often instructed to deal purel with the Confiscation end of a case, or to help people who are subject to enforcement where the terms of the original order need amendment.
